Nékter Sweet 16 Birthday Giveaway – Official Rules

1. Sponsor

The Nékter Sweet 16 Birthday Giveaway (the "Sweepstakes") is sponsored by Nékter Juice Bar, Inc., 27702 Crown Valley Pkwy, Ste D4 #446, Ladera Ranch, CA 92694 ("Sponsor" or "Nékter").

2. Eligibility

Open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older (or the age of majority in their state of residence, if older) at the time of entry. Employees, officers, and directors of Sponsor, its affiliates, franchisees, and advertising and promotion agencies; employees of Nékter franchise locations; and the immediate family members (spouse, parents, siblings, children) and household members of each are not eligible.

3. Sweepstakes Period

The Sweepstakes begins at 12:00:00 a.m. Pacific Time ("PT") on October 9, 2026, and ends at 11:59:59 p.m. PT on October 15, 2026 (the "Sweepstakes Period"). Order and mail-in entries (Methods A and C) are accepted only on October 9, 2026, from 12:00:00 a.m. to 11:59:59 p.m. PT (the "Order Entry Day"). Instagram entries (Method B) are accepted throughout the full Sweepstakes Period. Sponsor's computer is the official timekeeping device.

4. How to Enter

There are three ways to enter. Entries from Methods A and C are placed in the "Order Pool." Entries from Method B are placed in the "Instagram Pool."

Method A – Order Entry (Order Pool): On the Order Entry Day (October 9, 2026), place an order through the Nékter mobile app, or place an order at a participating Nékter location and provide your Nékter Rewards account information at checkout. Each qualifying order earns one (1) entry. There is no limit on the number of qualifying orders per person. Orders placed before or after October 9, 2026, orders placed through third-party delivery services, and orders placed without Rewards account information are not eligible. Joining Nékter Rewards is free.

Method B – Instagram Entry (Instagram Pool): During the Sweepstakes Period, (1) follow @nekterjuicebar on Instagram, and (2) comment on Sponsor's official birthday post (published on or about October 9, 2026) with your favorite Nékter order and tag at least one friend. Limit one (1) Instagram entry per person; additional comments or tags will not earn additional entries. Your account must be public at the time of entry and winner selection so Sponsor can verify eligibility. Entrants must have an Instagram account (free to create) and comply with Instagram's Terms of Use. Comments that are offensive, inappropriate, or infringe the rights of others will be disqualified at Sponsor's sole discretion.

Method C – Free Mail-In Entry (Order Pool): Hand-print your full name, mailing address, phone number, email address, and date of birth on a 3" x 5" card and mail it in a stamped envelope to: Nékter Sweet 16 Giveaway, 27702 Crown Valley Pkwy, Ste D4 #446, Ladera Ranch, CA 92694. Limit one (1) card per outer envelope; there is no limit on the number of envelopes a person may send. Mail-in entries must be postmarked on or before October 9, 2026, and received by October 15, 2026. Each eligible mail-in entry has the same chance of winning as one Order entry. Mechanically reproduced entries are void.

Entries that are incomplete, illegible, late, lost, misdirected, or submitted through automated means are void. Use of multiple accounts or identities to exceed entry limits will result in disqualification.

5. Winner Selection and Odds

On or about October 16, 2026, Sponsor will conduct random drawings from all eligible entries received: ten (10) potential winners from the Order Pool and six (6) potential winners from the Instagram Pool. Odds of winning depend on the number of eligible entries received in each pool. Limit one (1) prize per person and household. Sponsor's decisions are final and binding.

6. Prizes

Sixteen (16) prizes are available. Each winner will receive one (1) $50 Nékter gift card (Approximate Retail Value ("ARV") $50). Total ARV of all prizes: $800. Gift cards are subject to Sponsor's standard gift card terms and conditions, have no cash value, and are not redeemable for cash except where required by law. No transfer or substitution of prize by winner; Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable. All taxes are the sole responsibility of the winner.

7. Winner Notification

Order Pool winners will be notified by email and/or phone using the contact information on their Nékter Rewards account or mail-in entry. Instagram Pool winners will be notified by direct message from Sponsor's official @nekterjuicebar account only. Sponsor will never ask winners for payment, passwords, or financial information. Potential winners must respond within seventy-two (72) hours of notification and may be required to confirm eligibility. If a potential winner does not respond in time, is found ineligible, or a notification is returned as undeliverable, the prize may be forfeited and an alternate winner selected from the remaining eligible entries in the same pool. Winners may be announced on Sponsor's social channels and website on or about October 16, 2026, by first name and last initial or Instagram handle.

8. Publicity

Except where prohibited by law, acceptance of a prize constitutes consent for Sponsor to use the winner's name, city and state, Instagram handle, and entry comment for advertising and promotional purposes without further compensation or notice.

9. General Conditions

Sponsor reserves the right to disqualify any person it finds tampering with the entry process or the operation of the Sweepstakes, acting in violation of these Official Rules, or acting in an unsportsmanlike or disruptive manner. If the Sweepstakes cannot run as planned due to fraud, technical failures, or any other cause beyond Sponsor's control that corrupts its administration, security, or fairness, Sponsor may cancel, modify, or suspend the Sweepstakes and, if canceled, award prizes by random drawing from eligible entries received before cancellation.

10. Release and Limitation of Liability

By entering, entrants agree to release and hold harmless Sponsor, its affiliates, franchisees, and agencies, and their respective officers, directors, employees, and agents (the "Released Parties") from any and all liability, claims, or damages arising from participation in the Sweepstakes or the acceptance, possession, or use of any prize. The Released Parties are not responsible for lost, late, incomplete, or misdirected entries; technical malfunctions of any network, app, or platform; or errors in the printing or administration of the Sweepstakes.

11. Instagram Disclaimer

This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. By entering, entrants release Instagram and Meta Platforms, Inc. from all liability related to the Sweepstakes. Information collected is provided to Sponsor, not to Instagram.

12. Privacy

Personal information collected in connection with the Sweepstakes will be used in accordance with Sponsor's Privacy Policy.

13. Disputes and Governing Law

These Official Rules are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of the Sweepstakes will be resolved individually, without resort to any form of class action, in the state or federal courts located in Orange County, California.
